The Warehouse Group has this privacy statement because we understand that it is important for you to know how we collect, store, use and share your personal information. By “The Warehouse Group” we mean the following companies and their associated brands:

If you are applying for a role with us, your personal information is handled in accordance with our Candidate Privacy Statement.
By placing an order to purchase products from a third-party seller via our websites, apps and platforms, you understand that personal information that is necessary to fulfil your order will be disclosed to the third-party seller as set out in section 8 of the privacy statement, and that the terms of the third-party seller’s Privacy Policy will also apply.

PERSONAL INFORMATION
In this statement, “personal information” means the same as it does in the Privacy Act 2020 (“Privacy Act”). In general terms, this includes any information that can be used to personally identify you. This may include (but is not limited to) your name, age, gender, address, contact details (including phone numbers and email addresses), images of you, your financial information including your payment information. If the information we collect personally identifies you, or you are reasonably identifiable from it (for example, if we combine seemingly anonymous data with other personal information, we hold about you), then the information is considered personal information.
CHANGES TO THE PRIVACY STATEMENT
We may change this privacy statement from time to time. Updated versions of this statement will be posted on our website. If we make any significant changes, we will provide you with reasonable notice by informing you through The Warehouse Group websites. By continuing to engage with us or use our services after any such notice period, you will be deemed to have accepted the updated version of this statement.
2. WHAT PERSONAL INFORMATION DO WE COLLECT?
Where you provide us with any personal information about another person, you confirm that you have collected the personal information in accordance with the Privacy Act, that you are authorised to provide the personal information to us and that we may collect, use and disclose the personal information for the purpose of providing the Services to you or as otherwise permitted by this privacy statement.

Video footage or still images, where our stores operate video surveillance systems (wherever you see video surveillance systems and/or a sign notifying you “CCTV IN OPERATION” or similar, including in-store and in our carparks).

The number plate of the vehicle you have used to visit our store, if that store uses an Automatic Number Plate Recognition (ANPR) system.

Details of the products (including clothing and footwear sizes) and services that you have purchased from us or have shown interest in.

Payment information and tokenised card data, in order to facilitate the payment for the goods and/or services.

Where you have or intend to purchase goods and/or services which need to be obtained at a later date (for example, from another store location, or through a Quote Now/Pay Later service), or you have purchased an additional warranty or service, we may collect your name, email address, contact number and mailing or street address).

If you access our in-store Wi-Fi, we collect your name, email address, marketing opt-in preference, device identifier, device operating system and your web browser settings.

Collection from or provision by third parties
You understand that we (and acknowledge and authorise us to) also collect or are provided with personal information about you from third parties from time to time, such as:

Our contractors, business partners, suppliers, manufacturers and service providers who we use to assist us to carry out our business activities and provide any services you have requested.

Organisations you are a member of, where that organisation has negotiated a partnership relationship with us and provides us with membership details. If information is shared with us in this way, it will be disclosed in your Member Organisation’s privacy policy or statement.

Where you redeem a reward from a third party’s rewards programme, where that reward is supplied by us, your name and delivery address may need to be shared with us in order for us to supply your selected reward and provide warranty and after sales activity.

Where you purchase any products from us using an after-pay type system, then we receive your name, contact information and purchase for the purposes of reconciliation, order management and investigation of any purchase disputes. If you use a delivery service (eg DoorDash) to purchase products from us to be delivered to you, then we may receive certain limited information relating to you such as your name and the products purchased, in order to fulfil your order. If you make an insurance claim your insurer might provide us with your personal information in the course of requesting quotations and products to assess and settle your claim. For details of precise information shared with us (if any) please contact your insurer.

We have agreements with other retailers whereby we can share and access information loaded into the Auror system for the purpose of crime prevention and ensuring the safety of retail workers and customers.  Retailers we currently have Auror access agreements with are:

Other retailers and management in the same physical proximity as one of our Stores may share information with us for the purpose of preventing criminal or anti-social behaviour and keeping our customers, staff and property safe.

Law enforcement agencies and other Government entities may share personal information with us for the purposes of their statutory duties and investigations.

If we are investigating alleged criminal or anti-social behaviour including fraud we may also collect information from a person alleging they have been the victim, the alleged person undertaking the activity, gather information from witnesses, information about verification of your applicable identification from the relevant authority and confirmation of the delivery status and address from delivery providers for deliveries of our products.

Advertisers including social media platforms (for example, Facebook).
In some cases, we may purchase second party data from any of the categories of third parties listed above (commonly known as mailing lists). Where we do so, we seek appropriate warranties from those third parties that they have the necessary consents and authorisations to sell and disclose any personal information contained in those datasets to us for our own business purposes. Any personal information we collect from third parties for the purposes identified in this statement may be combined with other information we hold about you.
We may also receive your personal information from another party by any other means. If we do, we will apply NZ’s privacy laws, including the Privacy Act in deciding whether it is lawful to retain the information received.

4. WHY DO WE COLLECT PERSONAL INFORMATION
The primary purpose for which we collect information about you is to enable us to perform our business activities and to provide the best possible customer service.

Your personal information will be collected by The Warehouse Group company to which it was provided:

Your personal information will be held at 26 The Warehouse Way, Northcote, Auckland. It may also be held for us in the data centres, platforms and systems of our third-party service providers, some of which may be located outside of New Zealand.
Your personal information will not be shared, sold, rented or disclosed other than as described within this statement or as required or permitted by any law (including the Privacy Act).
5. USE OF PERSONAL INFORMATION
We use personal information to provide you with information or advice about our existing and new products and services or those of other The Warehouse Group businesses. We may combine and analyse a range of personal information we hold about you for the purpose of providing a more personalised shopping experience and/or providing more targeted advertising based on your preferences. We also use and disclose personal information to conduct promotions on our own behalf and on behalf of selected third parties (for example if you enter a joint promotion that we are running with a third party, we may share your personal information with that third party for the purposes of facilitating the promotion).
If you register as a member of one of the Groups loyalty programmes such as MarketClub, BizRewards or myNoelLeeming, you acknowledge and accept that the retail brand that you signed up through may each communicate directly with you with marketing and promotional material, which may include exclusive offers and rewards not available to the general public.

Please note that if you unsubscribe from any of our marketing databases, you may still receive important product and service-related communications from us. You may also still receive marketing material from other retail brands within the Group or our third-party business partners if you have agreed or requested to receive information from those third parties. If you do not wish to receive marketing communications from these other organisations, you must let them know directly.

We will not provide any personal information to an advertiser or any other third party without your express consent or in accordance with this statement. However, we reserve the right to collate, provide and sell aggregated and anonymised datasets from customer derived information to third parties for their own commercial purposes, provided that the data contained in those datasets does not specifically identify you or any other individual. Although we take all reasonable steps to ensure these datasets do not identify any individual, including requiring recipients to comply with all applicable laws in relation to their use of any dataset, we cannot guarantee that a third party will not try to combine the data contained in these datasets with other information that the third party may hold about individuals in an attempt to identify an individual.

6. MOBILE NOTIFICATIONS

Third parties for repairs or quality issues
Where there is a product quality, safety or repair issue we may disclose your information to third parties as follows:

To manufacturers or suppliers of products or services for product quality purposes where you return a product to us.

To repairer agents to facilitate assessment or repair of a product.

Where the manufacturer or supplier has advised that they need to contact you for any material quality or safety issues related to a product or service you have purchased. In this case we will endeavour to contact you as well to advise of the issue and let you know that we will be sharing your information with the manufacturer/supplier.
Disclosures to protect property and/or safety
We may disclose your personal information where we believe that disclosure is necessary to protect our or your rights, property, or safety or the rights, property and safety of others. In particular:

If we have good reason to suspect you of committing a crime or anti-social behaviour on our premises your personal information (which may include CCTV footage, camera stills, number plate recognition, name, contact details, details of crime or anti-social behaviour) may be shared with the Police and may be uploaded into the Auror System ([email protected]).

When it is permitted under the Privacy Act or required by law for legal compliance or law enforcement (including government agencies with statutory law enforcement responsibilities.

To Government agencies with statutory roles enabling them to request data from us including the Police, Inland Revenue, Ministry of Social Development, Customs and the Ministry of Business, Innovation and Employment.

whereby they can access the information we have lodged in the Auror System and we can also access information they have lodged into the Auror system for the purpose of crime prevention and ensuring the safety of retail workers and customers.

We may disclose still images taken from our CCTV system to other retailers (or mall management) located within the same physical vicinity as us, where we reasonably believe that it is necessary in order to protect our staff, customers or property or to assist other local businesses/malls to do the same. These images will only be shared with appropriate privacy restrictions in place.
Disclosures to enforce or apply our terms and conditions

We may pass your personal information to selected agencies in order to undertake due diligence of you as a customer, or to enforce or apply our terms and conditions. This information may include your name, date of birth, age, mailing/residential address, contact details, occupation, place of work, signature, government identifiers such as ird/gst number, driver’s license, passport number, transactions with us, payment history, other relevant information you provided regarding outstanding balances.

If you apply for or have a credit or commercial account with us, you agree to us carrying out credit checks and due diligence on you, and your company and its Directors. When you engage us to undertake or arrange repairs of products on your behalf we will need to disclosure your personal information contact details to the repair service provider

When you arrange for a product to be delivered or installed your personal information contact details will need to be disclosed to the delivery company

Where your insurance company is arranging for purchases of goods or services through us to settle an insurance claim made by you we need to provide proof the goods have been supplied (eg by sharing copies of invoices or sales reports)

When you purchase a Product Protection or Damage Plan from us we disclose your personal information to the Insurer and Administrator of the relevant Plan. Their contact details can be found within the terms and conditions provided to you at the time of purchasing the Plan.

Where a third party you have a relationship with contacts us to investigate fraud on your behalf (eg your bank, afterpay type provider, telecommunications company). We will ask this third party to provide us with proof of you authorising this information to be released.
​ 9. DISCLOSURE OF PERSONAL INFORMATION OUTSIDE OF NEW ZEALAND
We do not disclose personal information to any third parties outside of New Zealand except where the third party is our Agent (as defined in the Privacy Act) and is prohibited from using the information for their own purposes.
​10. PROTECTION AND RETENTION OF PERSONAL INFORMATION
We take reasonable steps to protect the personal information that we hold from misuse, loss, or unauthorised access or modification.
Where our stores operate CCTV systems, they ensure that access to CCTV footage is limited to staff who have a legitimate purpose to view and use it.

We retain your personal information only for as long as we need it and we destroy the information we no longer need in a secure manner. CCTV footage is automatically deleted on a regular cycle, though in some cases it may be retained for longer where necessary to investigate an incident or assist the Police to investigate an offence.

11. RIGHT TO ACCESS OR CORRECT YOUR PERSONAL INFORMATION
You may request access to any personal information we hold about you at any time by contacting us at [email protected]. 
Your request will be processed in accordance with the Privacy Act.
If you make an access request, we will ask you to verify your identity. There may be instances where we cannot grant you access to the personal information we hold. For example, we may need to refuse access if granting access would interfere with the privacy of others, or if it breaches legal professional privilege. If that happens, in most circumstances we will give you written reasons for any refusal.
We note that we are unable to provide CCTV footage of third parties in car-park incidents unless this is requested by the NZ Police.
We may charge a reasonable fee for making your personal information available to you or providing you with copies of it.
If you believe that personal information we hold about you is incorrect, incomplete or inaccurate, then you may ask us to amend it. We will consider if the information requires amendment and will not charge for making any amendments. If we do not agree that there are grounds for amendment, then we will add a note to the personal information stating that you disagree with it. Registered users of our websites and apps can access and update their user details online. We request that you keep your information as current as possible so that we have the most accurate and up to date information available to us.
 
12. COMPLAINTS ABOUT A BREACH OF PRIVACY
If you believe that we have breached this statement or the Privacy Act or you have any questions or concerns about this statement, please contact us using the contact information below and provide details of the incident so that we can investigate it.

We have a formal procedure for investigating and dealing with complaints. Once the Privacy Officer receives a complaint the Privacy Officer will commence an investigation with the relevant business unit and will endeavour to determine the nature of any breach and how it occurred.

We may contact you during the process to seek further clarification if necessary. If a breach is found, the Privacy Officer will escalate the matter to management so that the process which was breached can be rectified to help prevent any further breaches from taking place. We will also contact you to inform you of the outcome of the investigation. We will endeavour to resolve all investigations within a reasonable timeframe.
